KVOA News, Eric Fink, January 2025, Prop 314
Hathaway focused on:
- his main opposition against 314, (makes crossing the border other than a port of entry would be a state crime), no funding in the bill, would take his department away from their core mission of responding to violent crime and property crime
- with the 10 to 1 ratio of Feds to SO they should be responsible immigration process
- the jails cannot afford to jail immigrants, the county attorney offices cannot handle the overload, the courts cannot handle the overload
- voters were mis-led and thought it was a law against Phentanol, without knowing there is immigration language in the Prop.
- 314 is unconstitutional - based on SB 1070 in 2010 where the Federal Gov found it unconditional
- it's not the responsibility of local law enforcement to assist the Federal agencies with immigration issues
- he will not have his department assist with immigration issues (stating he would be in contempt of court if he did)
- the state withheld $250,000 from Santa Cruz County for border security because he said if it held up he will not enforce 314 immigration section (many reasons why that happened and also political)
- philosophy due to a large number of Hispanics in Santa Cruz County he does not want to ask people to show their papers, racial profiling,
- he believes it is an illegal law because there is case law on this
